Summ Online Store Terms and Conditions
1. Scope and Validity of the Terms
1.1. These terms apply to all legal relationships between individuals and the online store at www.summ.ee (hereinafter referred to as “Summ e-store”) owned by LPTRADE OÜ, which arise when purchasing products through the Summ e-store.
1.2. In addition to these terms, the legal relationships that arise when purchasing products through the Summ e-store are governed by the laws in force in the Republic of Estonia.
1.3. LPTRADE OÜ reserves the right to change and supplement these terms and the price list in accordance with the development of the Summ e-store and in the interest of a better and more secure user experience. Any changes or supplements to the terms and price list will be announced through the website www.summ.ee. The changes or supplements to the terms and price list take effect from the moment they are published on the website www.summ.ee. If you submitted your order before the changes to the terms took effect, the terms in force at the time you submitted your order will apply to the legal relationship between you and LPTRADE OÜ, unless otherwise provided by law or these terms.
2. Prices
2.1. The prices in the Summ e-store are valid for payments made within the invoice’s due date as stipulated in section 4.
2.2. All prices include 22% VAT as applicable in the Republic of Estonia.
3. Shopping Cart and Order Placement
3.1. You can modify the quantity of products in the shopping cart. To proceed with the order, click “Continue.” You will be directed to the customer information page.
3.2. On the customer information page, enter the required information and choose a payment method. After entering all the necessary details and selecting a payment method, click “Submit Order.” You will be redirected to the payment page.
3.3. Be careful when filling in the fields on the customer information and order confirmation pages, as the accuracy of this information affects the timely and uninterrupted delivery of the products you purchased.
3.4. The sales contract for the products is considered concluded (Contract Formation) from the moment the amount due as per the order confirmation is credited to the Montonio Finance UAB bank account.
4. Entry into force of the sales contract
4.1. You can pay for the products using the available payment methods, which are visible when you click “Submit Order.” Payments are processed by Montonio Finance UAB.
5. Product Delivery and Handover
5.1. After the contract is formed in accordance with section 3.4 of the Terms, the products will be delivered to you based on the contact information you provided during the order process.
5.2. The courier company will deliver the order within the timeframe specified in the product description. Delivery within Estonia for in-stock items generally takes 1-7 days.
5.3 If the product you ordered is not in stock and needs to be ordered from a supplier, or if it becomes clear that the product cannot be delivered within the timeframe specified in the product description due to circumstances beyond the control of LPTRADE OÜ, you will be notified within 2 working days via the contact phone or email you provided during the order process, and you will also be informed of the new delivery time.
5.4. You will be notified by phone or email when your order has been handed over to the courier company.
5.5. The courier company will deliver the products to the parcel locker you specified during the order process. Changing the delivery destination later is not possible.
5.6. Please ensure the accuracy of the contact information you provide during the order process to avoid delays and misunderstandings in product delivery. LPTRADE OÜ and the courier company are not responsible for delays or misunderstandings in product delivery caused by inaccurate or incorrect information provided during the order process.
5.7. If the product’s packaging is damaged during transportation, please report the damaged product packaging via email to info@summ.ee or by calling LPTRADE OÜ at +372 51997390.
6. Order Cancellation and Product Return
6.1. You have the right to cancel your order after paying for the products but before delivery by sending a notification to info@summ.ee, including the order number and your bank account number, or by calling LPTRADE OÜ at +372 51997390.
6.2. After receiving the products, you have 14 days to return or exchange the product by sending a notification to info@summ.ee with the order number, your bank account number, and the address where the returned products are located, or by calling LPTRADE OÜ at +372 51997390.
6.3. In the event of order cancellation as described in section 6.1 or withdrawal from the order as described in section 6.2, the amount paid for the purchase will be refunded to you, except for the shipping costs associated with returning the product to the warehouse (section 6.5). The refund will be credited to your bank account within 14 days of the product’s return to LPTRADE OÜ, provided that you have returned the product within the same timeframe, except in the cases provided for in sections 6.4, 6.5, and 6.6 of these terms.
6.4. The returned product must be complete (including all items included in the product packaging, such as cables, etc.). If the product was purchased during a promotion that included an additional product, you must return the entire set (i.e., all products).
6.5. Summ e-store reserves the right to charge the customer for the cost of returning the product and deduct this amount from the refund.
6.6. If the returned product (and its packaging) has deteriorated due to reasons not attributable to LPTRADE OÜ and the deterioration results from improper use of the product, LPTRADE OÜ has the right to offset the decrease in the product’s value against the amount you paid for the product. LPTRADE OÜ will send you an offset statement to the email address you provided during the order process. If you disagree with the offset amount, you have the right to involve an independent expert to assess the product’s depreciation. The cost of the assessment will be shared equally between you and LPTRADE OÜ, unless one party’s position is found to be clearly unreasonable, in which case the unreasonable party will bear the cost of the assessment.
7. Warranty and Return of Non-Conforming Products
7.1. LPTRADE OÜ is responsible for any non-conformities or defects in the products that become apparent within 2 years of the products being delivered to you.
7.2. LPTRADE OÜ is not responsible for:
- damage or deterioration caused by your fault;
- defects resulting from improper use of the product;
- normal wear and tear from regular use.
7.3. In the event of non-conforming or defective products, you have the right to request a replacement product that meets the requirements or cancel the order and return the defective product at the expense of LPTRADE OÜ.
7.4. In the event of the return of a non-conforming product, the amount paid for the product (including shipping costs) will be credited to the bank account you provided within 14 days of the product being returned to LPTRADE OÜ.
7.5. In addition to the rights under the warranty, you also have other rights provided by law.
8. Liability and Force Majeure
8.1. LPTRADE OÜ is liable to you and you are liable to LPTRADE OÜ for damages caused by a breach of these terms in cases and to the extent provided by the laws in force in the Republic of Estonia.
8.2. LPTRADE OÜ is not liable for damages caused to you or delays in product delivery if the damage or delay is caused by circumstances that LPTRADE OÜ could not influence and could not foresee (force majeure).
9. Other Terms
9.1. All personal data disclosed during visits to the Summ e-store and purchases will be treated as confidential information. The encrypted communication channel with banks ensures the security of the buyer’s personal data and banking details. LPTRADE OÜ does not have access to this data.
9.2. In matters not specifically addressed in these terms, the laws of the Republic of Estonia will apply.
9.3. Disputes arising between you and LPTRADE OÜ in connection with orders and purchases through the Summ e-store will be resolved through negotiations. If an agreement cannot be reached, you have the right to turn to the Consumer Disputes Committee to protect your rights.
10. Disclaimer
10.1. Product images are for illustrative purposes only.
10.2. Product prices and availability are subject to change without notice. In such cases, LPTRADE OÜ reserves the right to withdraw from the sale and refund the customer within 10 business days.
10.3. LPTRADE OÜ reserves the right to cancel the sale if any of the following issues occur: a human error in price entry or a technical error in the system (e.g., if a laptop that costs 2500 EUR is suddenly listed for 250 EUR, it is clearly a mistake. Therefore, we expect the customer to understand that this is an error and that the product cannot be sold at such a price).
10.4. Product information is checked and updated regularly. The data may have changed since your last visit. Due to incomplete data sheets from manufacturers, there may be inaccuracies in the product information on the Summ e-store. In such cases, the Summ e-store does not assume responsibility for the accuracy of the product information. We recommend verifying the accuracy of product information through our customer service at +372 51997390 before making a purchase.
